ゴーン被告「理屈通らない」西川社長の不起訴処分

会社法違反（特別背任）などで起訴された日産の前会長カルロス・ゴーン被告（65）の弁護団の弘中惇一郎弁護士（73）が20日、都内で取材に応じた。同弁護士はこの日、行われた弁護団の会議で、23日に東京地裁で行われる、会社法違反の事件に関する第1回の公判前整理手続きの場で、同被告の役員報酬を有価証券報告書に過少に記載したとして金融商品取引法（金商法）違反で起訴された事件を巡って告発された、日産の西川広人社長が不起訴処分となった件について、検察側に説明を求める方向になったと明かした。
弘中弁護士は「西川さんが全く責任を問われず、ゴーンさんだけ問われるのは釈然としない。その点について、検察官に説明を求めることを検討しています」と語った。同弁護士は「ゴーンさんは、自分も西川さんも金商法違反にならないと思っているわけです。理屈の問題として、もし仮に数字が違っていて、かつ最高責任者が書類提出者として責任を問われるのであれば、なぜ西川さんに対し、検察官は何もしないのか？　理屈が通らないじゃないか、という話」と疑問を呈した。
そして「トップは、ただはんこを押すだけで細かい数字を知らないと言うなら、知らないのだろうし…。でも、西川さんも本当に知らなかったということになるのかどうか、司法取引をしたのかどうかも、よく分からない。いずれにしても、うやむやで代表取締役も続行する。筋が通らないということ」と首をかしげた。ゴーン被告も西川社長の不起訴については「理屈が通らない」と話しているという。
また東京地検が、ゴーン被告がサウジアラビア人の知人ハリド・ジュファリ氏の会社に、子会社から1470万ドル（現レートで約16億円）を入金させたとされる事件について、友人側から約16億円を提供されたと加え、訴因変更を請求した件に対して「今ごろ、どういう趣旨でやるんだという説明を求めたい」と語った。
金商法に関する公判前整理手続きが、6月24日に入ったことも明らかにした。【村上幸将】
